Conditions of Hire from J&L Car Hire
NOW THEREFORE THE PARTIES AGREE AS FOLLOWS:

The vehicle and accessories rented in terms of this rental contract always remains the exclusive property of the lesser.

1. The Lessee hereby acknowledges having inspected the Vehicle and accessories and having found and received same. Same roadworthy and in good order and repair. The Lessee shall be obliged to return in the same state, reasonable wear and tear excluded.
2. The Lessee shall pay to the Lesser, before taking possession of the Vehicle and accessories the following:
2.1 The cost to be charged for the period of hire as specified on the J&L Car Hire Application:

2.2. A deposit as required which shall be obtained by the Lesser during the period of hire which shall be refundable to the Lessee on return of the goods in an undamaged and good condition.

3. Should the Vehicle and /or accessories be damaged in any way whatsoever upon return thereof to the Lesser, the Lessee shall be liable for repair thereof to the satisfaction of the Lesser. Should the Lesser, as it may be entitled, though not obliged, to do, claim from its insurance company for the repair of such damages, the Lessee undertakes, and shall be obliged to pay to the lesser, upon demand, the Lesser excess payment under such policy. In the event of theft thereof, the Lessee shall be liable to repay /compensate the Lesser, upon its demand for the loss thereof, in an amount equal to the replacement value thereof.
4. The Lessee undertakes and accepts that the Vehicle and accessories:
4.1 May and shall only be used for the purpose and carry the capacity thereof, as it may be intended / fit for under its competency certificate, and that the Vehicle shall only be towed with a suitable towing vehicle, according to Law.
4.2 Shall at all times be used / kept according to Law and in compliance with all road-traffic regulations and not to do or permit to be done therewith, anything that my cause any liability whatsoever, to the Lesser as owner thereof and /or endanger / put risk its ownership therein and/or expose same to any form of right of retention or lien thereto by any third party.
4.3 Shall be used by the Lessee at his own risk, whilst the Lessee hereby indemnifies and safeguard the Lesser against any loss or liability that may occur or arise from the Lessees use thereof resulting in damage person or property or any other whatsoever.
4.4 Shall at his own cost, upon the termination of the hire period, return to the Lesser at its place in Mossel Bay failing which the Lesser shall be entitled though not obliged to, to recover same from wherever it may be found at the cost and risk of the Lessee, which costs the lessee shall be liable to refund to the Lesser immediately upon demand.

4.5 May at any reasonable time, be inspected by the Lesser and / or its authorized agent, in order to ensure that the Lessee, at all times, duly and properly complies with all the terms hereof, failing which, in the absolute discretion of protection / safeguarding / repossession of the Vehicle and accessories and / or the cancellation of this agreement.

5. The Lessee hereby consents to the jurisdiction of the Magistrates Court in any legal action that may arise here from and hereby chooses as his domicilium citandi et executants for such legal action, the mentioned above and also hereby accepts to be liable for payment of all legal charges on Attorney and Client scale in and legal action that the Lessor may institute arising from this agreement / the Lessees breach of any condition hereof / the Lessees termination hereof and / or its enforcement of any term thereof.
6. The Lessee shall be responsible to obtain any necessary road permits.
7. The Lesser accepts no liability for losses or damages suffered by the Lessee because the Vehicles hired not being able to perform for any reason whatsoever.

Terme en Voorwaardes

TERME & VOORWAARDES T.O.V. MOTORVERHURING BY J&L CAR HIREDAAROM STEM DIE PARTYE SOOS VOLG IN:

Die voertuig en toebehore wat ingevolge hierdie huurkontrak gehuur word, bly altyd die eksklusiewe eiendom van die Verhuurder.

1. Die Huurder erken hiermee dat hy die Voertuig en toebehore geïnspekteer het en dit gevind en ontvang het. Dieselfde padwaardig en in goeie toestand en herstel. Die Huurder sal verplig wees om in dieselfde toestand terug te keer, redelike slytasie uitgesluit.

2. Die Huurder moet die volgende aan die Verhuurder betaal voordat hy die Voertuig en toebehore in besit neem:

2.1 Die koste wat gehef moet word vir die huurperiode soos gespesifiseer op die J&L Car Hire Application:

2.2. 'n Deposito soos vereis wat deur die Verhuurder gedurende die huurperiode verkry sal word wat aan die Huurder terugbetaalbaar sal wees by die terugbesorging van die goedere in 'n onbeskadigde en goeie toestand.

3. Indien die Voertuig en/of toebehore op enige manier hoegenaamd beskadig word by terugbesorging daarvan aan die Verhuurder, sal die Huurder aanspreeklik wees vir herstel daarvan tot die bevrediging van die Verhuurder. Indien die Verhuurder, soos hy geregtig mag wees, alhoewel nie verplig nie, om te doen, van sy versekeringsmaatskappy eis vir die herstel van sodanige skade, onderneem die Huurder, en sal verplig wees om aan die Verhuurder, op aanvraag, die Verhuurder bybetaling te betaal. onder sodanige beleid. In die geval van diefstal daarvan, sal die Huurder aanspreeklik wees om die Verhuurder, op sy eis vir die verlies daarvan, terug te betaal/te vergoed in 'n bedrag gelykstaande aan die vervangingswaarde daarvan.

4. Die Huurder onderneem en aanvaar dat die Voertuig en toebehore:

4.1 Mag en sal slegs vir die doel gebruik word en die kapasiteit daarvan dra, soos dit mag bedoel / geskik is vir onder sy bevoegdheidsertifikaat, en dat die Voertuig volgens Wet slegs met 'n geskikte insleepvoertuig gesleep sal word.

4.2 Moet te alle tye ooreenkomstig die Wet en in ooreenstemming met alle padverkeersregulasies gebruik / gehou word en nie om daarmee te doen of toe te laat dat dit gedoen word nie, enigiets wat my enige aanspreeklikheid hoegenaamd veroorsaak, teenoor die Verhuurder as eienaar daarvan en/of in gevaar stel. / stel sy eienaarskap daarin in gevaar en/of stel dit bloot aan enige vorm van retensiereg of retensiereg daarop deur enige derde party.

4.3 Sal deur die Huurder op eie risiko gebruik word, terwyl die Huurder hiermee die Verhuurder vrywaar en beskerm teen enige verlies of aanspreeklikheid wat mag voorkom of voortspruit uit die Huurders se gebruik daarvan wat lei tot skade aan persoon of eiendom of enige ander hoegenaamd.

4.4 Sal op eie koste, by die beëindiging van die huurtydperk, na die Verhuurder op sy plek in Mosselbaai terugkeer, by gebreke waarop die Verhuurder geregtig is, maar nie verplig nie, om dit te verhaal van waar dit ook al gevind mag word teen koste en risiko van die Huurder, wat koste sal die huurder aanspreeklik wees om onmiddellik op aanvraag aan die Verhuurder terug te betaal

4.5 Mag te enige redelike tyd deur die Verhuurder en/of sy gemagtigde agent geïnspekteer word om te verseker dat die Huurder te alle tye behoorlik en behoorlik voldoen aan al die bepalings hiervan, by gebreke wat, na die absolute diskresie van beskerming / beveiliging / terugneming van die Voertuig en toebehore en / of die kansellasie van hierdie ooreenkoms.

5. Die Huurder stem hiermee in tot die jurisdiksie van die Landdroshof in enige regsaksie wat hieruit mag voortspruit en kies hiermee as sy domicilium citandi et executants vir sodanige regsaksie, bogenoemde en aanvaar ook hiermee om aanspreeklik te wees vir betaling van alle regsaanklagte op Prokureur en Kliënt skaal in en regstappe wat die Verhuurder mag instel voortspruitend uit hierdie ooreenkoms / die Huurders verbreking van enige voorwaarde hiervan / die Huurders beëindiging hiervan en / of die afdwinging daarvan van enige bepaling hiervan.

6. Die Huurder is verantwoordelik om enige nodige padpermitte te bekom.

7. Die Verhuurder aanvaar geen aanspreeklikheid vir verliese of skade wat deur die Huurder gely word nie deurdat die Voertuie wat gehuur word om enige rede hoegenaamd nie kan presteer nie.
